These Affiliate Program Terms of Service (“Agreement”) govern participation in the Affiliate Program (“Program”) offered by My Beach Concierge (“Company,” “we,” “us,” or “our”). By enrolling in the Program, you (“Affiliate,” “you,” or “your”) agree to comply with and be bound by the terms outlined below.
1. Program Enrollment
To enroll in the Program, you must submit a complete and accurate application via our designated affiliate platform. We reserve the right to approve or deny any application at our sole discretion, and approval may be revoked at any time for any reason.
2. Affiliate Obligations
By participating in the Program, you agree to:
Promote My Beach Concierge in a professional and ethical manner.
Use only the promotional materials, tracking links, and branding provided by the Company.
Accurately represent our services without making false or misleading claims.
You are solely responsible for ensuring that your website, content, and promotional methods comply with all applicable laws and regulations.
3. Commission Structure
Affiliates earn 10% commission on the net value of each completed sale referred through their unique affiliate link (excluding taxes, discounts, shipping, chargebacks, and returns).
Commissions are calculated only on valid, completed transactions.
The Company reserves the right to modify the commission rate at any time, with prior notice to affiliates.
4. Payment Terms
Commissions are paid on a monthly basis.
The minimum payout threshold is $10.00 USD. If your earned commission is below this threshold, it will roll over to the following month until the threshold is met.
Payments are made via direct deposit. You are responsible for maintaining accurate and current payment information within the affiliate platform.
All applicable taxes are your responsibility.
5. Prohibited Activities
You agree not to:
Engage in any form of deceptive or unethical marketing.
Alter or misuse My Beach Concierge branding or marketing materials.
Use your affiliate link for personal purchases (self-referral).
Engage in spam, bulk messaging, or unsolicited communications.
Bid on branded keywords or use domain names resembling our brand.
Violations may result in immediate termination from the Program and forfeiture of unpaid commissions.
6. Term and Termination
This Agreement remains in effect until terminated by either party.
Either party may terminate this Agreement at any time, with or without cause, by providing written notice.
Upon termination, all affiliate links must be removed, and all promotional activity must cease.
In cases of breach or fraudulent activity, the Company reserves the right to withhold any unpaid commissions.
7. Independent Contractor Status
Affiliates operate as independent contractors. Nothing in this Agreement shall create any partnership, joint venture, employment, or agency relationship between the Affiliate and the Company.
8. Limitation of Liability
To the fullest extent permitted by law, the Company disclaims any and all liability for indirect, incidental, consequential, or punitive damages, including loss of revenue or profits, arising from your participation in the Program.
9. Governing Law
This Agreement shall be governed by the laws of the State of Florida, without regard to its conflict of laws provisions.
10. Modifications
The Company reserves the right to modify this Agreement at any time. Affiliates will be notified of changes via email or platform notification. Continued participation in the Program after any changes constitutes your acceptance of the updated terms.
By joining the My Beach Concierge Affiliate Program, you confirm that you have read, understood, and agree to be bound by these Terms of Service.
